Lemon Law
Every year, consumers purchase vehicles that prove to have defects. However, the law offers certain protections known as "lemon laws" can provide rights and remedies for individuals facing these types of problems.  Title 56, Chapter 28 of the South Carolina Code of Laws delineates the conditions under which a consumer can seek relief under the lemon laws in the state of South Carolina.

"New motor vehicles" that fall under the protection of South Carolina's Lemon Laws include passenger cars, vans, and trucks; vehicles purchased on or after October 3, 1989; vehicles that have a defect that impairs use or considerably reduces market value; and vehicles that have defects that the manufacturer cannot repair within a reasonable time. To have the manufacturer repair, replace, or provide a refund for the vehicle, consumers must take certain initial steps, such as notifying the manufacturer of the problem.

Federal Fair Credit Reporting Act
When consumers apply for loans, credit, insurance, and leases, businesses determine if the individual in question is an appropriate candidate by inspecting his or her credit history. The Federal Fair Credit Reporting Act (FFCRA) is a federal law that protects consumers by requiring consumer-reporting companies to provide a free copy of an individual's credit report. By requiring such disclosures, consumers have the opportunity to review their credit and correct any problems that might appear.

If you have encountered difficulties in obtaining your credit report, or if you dispute the accuracy of the information in a credit report, an experienced consumer law attorney can assist you in asserting your rights under the FFCRA.

If you need more information regarding the FFCRA, please see the Federal Trade Commission's website.

Other Consumer Law Issues
Nate Fata also assists consumers with the following legal problems:
  • Car Fraud: This area of law encompasses situations where automobile dealers engage in deceptive, fraudulent practices, such as altering evidence regarding a vehicle's age, history, or mileage; selling a car without disclosing that the vehicle was damaged; and packing a loan or lease agreement with interest rates that are unconscionably high.
  • Breach of Warranty: Products typically come with express and implied warranties. If there is a defect in the product you purchased that violates an express or implied warranty, you may have certain rights against the manufacturer or seller for the breach of warranty.
  • Overcharge Matters: When businesses overcharge their customers, customers not only lose money that rightfully belongs to them but also find it difficult to recover the money that they are owed. A qualified consumer law attorney can ensure that overcharged consumers receive the compensation they deserve.
  • Foreclosure Defense: Many people are at risk of losing their homes to foreclosure and feel they have no other recourse. However, an experienced attorney can investigate and assess your circumstances to assist you in holding onto your home.
